1. Introduction and Acceptance of Terms
Zesiger.net is operated by Zesiger.net, a sole proprietorship, and access to it is governed by these Terms. By accessing the Services, you agree to be bound by these Terms and the Privacy Policy. Zesiger.net reserves the right to update these Terms and will give notice of material changes as set out in Section 15.

Key terms include: Account (your point of access to the Services), Content (materials posted), User/You (any person using the Services), User Content (content submitted by account holders), Services (all products and projects offered by Zesiger.net) and Subscription Plan (service tiers, where applicable).

Zesiger.net offers web development, software engineering, consulting and related digital services and projects. Zesiger.net reserves the right to modify or discontinue any service or project at any time.
5. User Conduct and Prohibited Uses
You may not engage in unlawful activities, transmit objectionable material, attempt unauthorised access, distribute malware, interfere with the integrity of the Services, infringe intellectual property, resell the Services, use screen scraping or overload the infrastructure. Violations may result in account suspension and reporting to law enforcement.
6. Intellectual Property Rights
The content of Zesiger.net and the associated intellectual property belong exclusively to Zesiger.net and its licensors. You retain the rights to the content you post and grant Zesiger.net a worldwide, non-exclusive, royalty-free, sublicensable and transferable licence to use it in connection with the Services.
7. Plans, Payments and Refunds
Where applicable, Zesiger.net offers plans and projects; details are available on the website or in an individual quote. You pay the applicable fees as agreed. Fee changes apply to new purchases only. Refunds are handled as described in the Refund Policy.
8. Service Availability and Uptime
The Services are provided "as is" and "as available", without any warranty that they will be uninterrupted or error-free. They may occasionally be suspended for maintenance. Zesiger.net is not liable for interruptions, errors or data loss.
9. Termination
You may close your account at any time, and your access ends immediately. Zesiger.net may suspend or terminate accounts without notice for violations or inactivity. Upon termination, accounts and content may be deleted in accordance with the data retention policy.
10. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. All warranties, including those of merchantability and fitness for a particular purpose, are expressly disclaimed. You download any materials at your own risk.
11. Limitation of Liability
Zesiger.net is not liable for indirect, incidental, special, consequential or punitive damages. Total liability is limited to the amounts paid in the preceding six months or CHF 100, whichever is greater.
12. Indemnification
You will defend and indemnify Zesiger.net against claims arising from violations of these Terms or misuse of the Services, including legal costs and damages related to your content or unauthorised use of the Services.
13. Governing Law and Dispute Resolution
These Terms are governed by Swiss law, excluding its conflict-of-law rules. The courts of Schmiedrued, Switzerland, have exclusive jurisdiction. Zesiger.net takes part in dispute resolution through the Swiss Conciliation Authority for E-Commerce.

15. Changes to Terms
Zesiger.net may amend these Terms at its discretion. Material changes will be announced 30 days in advance. Continued use after the changes take effect constitutes acceptance of the revised Terms.
16. Miscellaneous
These Terms, the Privacy Policy and the legal notices constitute the entire agreement. Provisions on ownership, warranty disclaimers, indemnification and limitation of liability survive termination. You may not assign these Terms; Zesiger.net may.
